Please read cerefully these terms and conditions of sale, "sale agreement".

The customer agrees to this sale agreement and all its terms and conditions, unless he has signed a separate agreement with Il-vino.com. In that case the separate agreement shall govern.

Important information about this legal contract
This agreement constitutes a legal contract between the customer an Il-vino.com and by shopping, or placing an order on the Site, the customer automatically accepts this sale agreement. With "you" and "your" we refer to the Customer; with "Il-vino.com" we refer to Il-vino.com S.p.a. and its affiliates. These terms and conditions are subject to change without notice, but the terms and conditions initially placed by the Customer will govern.

This Sale Agreement consitutes the entire agreement between the Customer and Il-vino.com relating to the purchase of goods or services in this Site. This sale agreement may be modified of terminated with a written statement signed by Il-vino.com. Electronic records, or electronic signatures are accepted under this Sale Agreement. The customer agrees to receive electronic records via a web browser or via e-mail. If the Customer wants to receive electronic records or in case he/she provides the record in a non-electronic form, he/she might contact il-vino.com at the address provided below.

In case of conflict between the terms and conditions stated on your order and this sale agreement or between the terms on your invoice, please remember that the provisions on this Agreement and on our invoice shall control.

Governing law
This agreement and any sales hereunder are governed by the Italian law without regard to law conflicts. The customer consents to the jurisdiction of the Italian law; in case of dispute, the court having jurisdiction is the court of Verbania.

Title; loss.
The goods herein purchased are property of the seller until they are paid by the purchaser.

Loss or damage that occurs during shipping by a carrier selected by Il-vino.com is Il-vino.com's sole responsibility.

Export sales.
If the Customer buys goods for the purpose of exporting them, he/she must obtain from the Government the documentation to export goods in a foreign country. Please remember that manufacturers' warranties  may vary or be null in case of goods exported outside Italy. The Customer should inquire further. Any liability is only for purchased products.

General legal disclaimer.
Il-vino.com declines all responasability for all warranties expressed or implied including but not limited to merchantability or fitness for a particular purpose. The manufacturers' warranties, if any, are not affected by this disclaimer.

Internet disclaimer.
Internet connectivity requires access from an internet provider. Contact your local provider for rates, terms and conditions.

Prices and information disclaimer.
All prices are subject to change. Due to changing market conditions, product discontinuation and price changes, errors in advertising, Il-vino.com reserves the right to make changes to the prices. 

Il-vino.com makes reasonable efforts to keep the Site constantly up-to-date but we don't guarantee for the Site's accuracy and we assume no responsability for any errors in the contents of the Site.

Limitation of liability.
IL-VINO.COM IS NOT RESPONSIBLE FOR LOSS OF PROFITS, BUSINESS OR ANY OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY A THIRD PARTY.

ANY CLAIM, DISPUTE, OR CONTROVERSY, WHETHER IN CONTRACT, TORT OR OTHERWISE, PREEXISTENT, PRESENT OR FUTURE AND INCLUDING STATUTORY, COMMON LAW, INTERNATIONAL TORT AND EQUITABLE CLAIMS AGAINST IL-VINO.COM , its agents, empoyees, successors, assigns or affiliates, collectively reffered to as "il-vino.com" in this paragraph, arising or deriving from this agreement and including relationship with third parties who are not signatories to this agreement, advertising of il-vino.com SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL FORUM under its code of procedure.

Orders; Terms of payment.
Orders ar not binding upon Il-vino.com until they are accepted by Il-vino.com. An order is considered as accepted when it is charged on the credit card. Terms of payment are under Il-vino.com's sole discrection. Invoices are due and payable within the time written on the invoice, measured from the date on the invoice.

Shipping.
Shipping charges of the orders can vary; see the page "Shipping" for our rates, options and offers. For the Customer's protection, we ship only to the address on the Customer's credit card. In some circumstances, international shipping is avilable. Please contact us for details.

Returns. 

• The Customer has the right to return merchandise for unspecified reasons within 7 days from the delivery. The goods have to be sent back INTACT to our address.

• Please call +39 0323 929262 or send an e-mail to our returns department and to obtain your number for returned merchandise. No returns will be accepted without this number. For faster service, remember to have the following information when you call: customer name, invoice number, serial number and nature of the problem. 

• All returns must be 100% complete, with all the original boxes and packing with all accessores and documentation provided.

• You are responsible for shipping charges on returned items; il-vino.com will match your shipping method on your replaced or exchanged items.
  
• Il-vino.com suggests you to insure your return shipment in case it is lost or damaged and use a carrier that provides you with proof of delievery.
  
• If the merchandise arrives damaged, you should REFUSE it to the carrier. If you accept the package make sure it is noted on the carrier's delivery record so that Il-vino.com can file a damage claim. If you do not notify Il-vino.com immediately for damaged merchandise within 7 days our regular return policy will govern.
  
• In case of DEFECTIVE returns, you can send it directly to il-vino.com within 7 days from the invoice date at il-vino.com's discrection.
  
• NON-DEFECTIVE returns are accepted by Il-vino.com within 7 days from the invoice date at il-vino.com discrection for credit or exchange.

Il-vino.com reserves the right to accept returns beyond 7 days from the invoice date. IF the product is accepted after 7 days the credit will be valid for future purchases only. Original shipping charges are not refunded for returned items, while il-vno.com will pay the shipping charges on the replacement.
